The Third Strip Complex – Givat Shmuel

An area that was originally designated as agricultural land, spanning 373 dunams in the eastern section of the city of Givat Shmuel, bordering Derech Yitzchak Rabin Road from the east and Derech Macabit Road from the South.

The GS/4040 Plan, which came into force recently, is a comprehensive outline plan that creates a planning framework for preparing plans by virtue of which building permits may be issued for construction at the complex. The plan determines a maximal framework of rights and principles for the continuation of the future planning of entire city of Givat Shmuel, including the Third Strip Complex.

Before the plan is validated, as part of the deliberation regarding the objections that was held in the Central District Committee for Planning and Construction, inter alia, opposing claims were discussed that were submitted by our firm in the name of the landowners in the complex. As part of the committee’s decision regarding the objections, a decision was reached to accept the objection in part, and to add to the complex an additional 200 residential units, as well as 15,000 square meters for employment. Moreover, the Committee issued instructions that will enable the conversion of the subterranean service spaces in the employment lots into principal subterranean areas that are associated with employment. Claims that were raised in the matter of various amendments that are required in the body of the protocol that was deposited, were also accepted.

When the plan came into force, the path was paved for the landowners in the complex to work toward preparing a unification and distribution plan, by virtue of which it will be possible to issue building permits on the complex.

Our firm has put together a large group of landowners in the complex, and will support the owners in all stages of planning. It will support and submit the objection to the said outline plan, for which the acceptance of its claims has created a significant improvement in the rights, and it will continue to handle the unification and distribution plan for allocation of the rights in certain lots. The firm will work to amalgamate the owners in private real estate partnership agreements, and continue to manage an appropriate system of contracts with the developer, financing institution, etc. All this in order to exercise the rights in accordance with the requirements and decisions of the landowner, until delivery of the units that were allocated to them based on the scope of their rights in the complex.

At this stage, the signature of the landowners on the real estate partnership agreement and the representation of our firm will enable the amalgamation of the owners within complete lots. This will make the exercising of rights easier, in terms of the way the landowners will make joint decisions in each lot.
