The National Labor Court clarifies the user’s obligation to hold a hearing for contractor employees – not under all circumstances

Contractor’s employee whose employment with the “user” is about to be discontinued is entitled to an explanation and an opportunity to respond; but on what occasions does the user have to conduct a hearing? Five months after the duty to conduct a hearing by the user was introduced in a precedential case, the National Labor Court continues to sharpen its borders, and determines that the duty will not apply in each and every case.
