Supreme Court ruled in favor of our client, Mr. Benjamin Cohen, against a claim filed by the Richter family
Our firm’s impressive legal achievement in the Supreme Court: After a complicated legal process, the Supreme Court affirmed a judgment of the District Court, which ruled in favor of our client, Mr. Benjamin Cohen, a foreign resident who lent money to the registered owner of a unique house in the beach-front suburb Arsuf, and received a mortgage on the house. Opposing party in the claim (the Richter family) argued that the mortgage was invalid as they were the true owners of the property, and they had not approved the mortgage. In its judgment, the court accepted our client’s position that he acted in good faith when the mortgage was registered in his name. According to the ruling, opposing party may redeem the mortgage only if they pay our client the full debt secured by the mortgage, which is currently approximately NIS 43 million. Benjamin Cohen was represented by Advs. Giora Erdinast, Dan Sella, Tal Erdinast, and Keren Saad from our firm.
