Compensation under section 197 of the Planning and Construction Law will be set at a lower value than the land’s market value.

In a recent Supreme Court ruling, two questions were examined:
(1) whether a land owner has compensation claim according to Section 197 of the Planning and Construction Law, in case of reduction in the planning potential of the land development and;
(2) if and how the market price should be taken into account if there is indeed a reduction of the potential of developing the land.
